Electronic filing mandate

Pass-through entities issuing over 100 K-1s are mandated to file electronically. 
The Mississippi Department of Revenue has issued an electronic filing mandate affecting all C Corporations, S Corporations, and Partnerships with assets greater than $5,000,000.
All Corporations and Partnerships with assets greater than $5,000,000, whose income and franchise return is due on or after January 1, 2018, are now required to electronically file the return.
There's a penalty of $25.00 for the 1st instance of noncompliance with this directive, and a penalty of $500.00 for each additional instance thereafter.

Returns supported for electronic filing

You can electronically file the following return types:
  • C Corporation
  • S Corporation
  • Consolidated / combined
  • Short year
  • Amended
  • Extension (with balance due)
  • Composite (part of main return)

Returns not supported for electronic filing

You can't electronically file the following return types:
  • Estimates
  • Extensions with no balance due
  • Returns with a foreign corporate address
  • Returns where the corresponding federal return isn't supported for electronic filing by the IRS

Signature requirements for electronic filing

You'll need to complete and sign Form 83-115 or Form 84-115 before you electronically file the return. Mississippi requires the date the authorized officer signs the form and PIN information are included in the e-file. Enter the PIN information and signature date on the
MSELF
screen, or leave blank if it matches the federal information you entered on the federal
ELF
screen.
Don't mail Form 83-115 or Form 84-115. The ERO retains the original form for 3 years and it needs to be available if Mississippi requests it. If for any reason the ERO ceases business, all signature forms the ERO currently maintains should be forwarded to the Mississippi Tax Commission.

Resubmit returns

If you need to make a change to a return that you have already electronically filed, and Mississippi has already accepted it, you'll need to amend the return.
If Mississippi rejects the return, you may make the changes, correct the rejection, and resubmit. If the state return can be retransmitted electronically, you'll need to resubmit and have Mississippi accept the return by the due date or 5 calendar days after you initially received the rejected acknowledgment, whichever is later.

Attachments

Mississippi requires a valid federal attachment in the electronic file. Therefore, if the federal return isn't supported for electronic filing by the IRS, you can't e-file the state return.
Mississippi allows PDF attachments in the electronic file.  There are no specific naming conventions for the files you attach. If applicable, you'll need to manually attach Ad Valorem tax receipts for corporations claiming credit on Ad valorem inventory tax and the special formula computation schedule for airlines, motor carriers, express companies, telephone and telegraph companies, and others. The following forms automatically generate as a PDF and attach to the state electronic file:
  • Form MS 4562
  • Form 83-450
  • Copy of federal Form 7004
  • Required Statements
  • Custom Statements
  • Shareholder’s K-1 Statements
  • MS Shareholder’s Distribution Included in Composite Return Schedule

Payment methods

Mississippi allows electronic funds withdrawal (direct debit), electronic funds transfer, or check for balance due returns, amended returns, and extensions. Partial payments aren't allowed when you pay via electronic funds withdrawal.
While you can't make credit card payments through UltraTax CS, you can make them through the Mississippi Tax Commission website. To instruct the client to pay by credit card, mark the
Credit card
field in the
MSELF
screen.
Bank information and a requested payment date are required when you're requesting EFW. Mississippi will use the bank information you enter on the federal
Bank
screen. If you have different bank information for Mississippi, use the
MSBank
screen in the
General
folder.
