F1040-164-01 e-file error

Form 8862 must be present in the return with Earned Income Credit Claimed Indicator checked. The e-File database indicates the taxpayer must file Form 8862 to claim Earned Income Credit after disallowance. (rule F1040-164-01)
You'll get this error if Form 8862 isn't included with the return and is necessary to file for an Earned Income Credit (EIC). Review the Form 8862 filing instructions. If your client meets the requirements for EIC and claims the credit on this return, you'll need to include Form 8862. If you think there's an error in the IRS database regarding the client's past EIC disallowance, contact the IRS e-file Help Desk at 866.255.0654.

Solution 1: Include Form 8862 for EIC

  1. Go to the Credits folder.
  2. Select the 8862 screen.
  3. Complete the data entry on the 8862 screen.
  4. Switch to Form view and select the 8862 folder. Mark the
    Earned Income Credit
    checkbox on Part I, line 2, and complete Part II.
  5. Re-create and retransmit the e-file.

Solution 2: Don't claim the EIC

To not claim the EIC and remove it from the return, review all the data entry on the EIC screen in the Credits folder. Re-create and retransmit the e-file.
